The second distribution occurred on March 21, 2007. By now, you should have received and cashed your settlement check. If you have not done so, you must do so immediately or contact the administrator to receive a check reissue. Any checks that have not been cashed are subject to forfeiture, pursuant to Court Order. Within the next several months Lead Counsel will be seeking an Order from the Court to release any funds that have not been cashed to charity, pursuant to the relevant Stipulations of Settlement.

This litigation and the Settlement may apply to you if you purchased items through non-internet auctions held outside the United States by the Sotheby's Auction Houses ("Sotheby's") and the Christie's Auction Houses ("Christie's") between January 1, 1993 and February 7, 2000 ("Buyers"), or (ii) who sold items through non-internet auctions held outside the United States by Sotheby's or Christie's between September 1, 1995 and February 7, 2000 ("Sellers"), excluding certain individuals and entities described in the Notice ("The Class"). In accordance with the terms and provisions of the Settlement Agreements, A Second Notice and personalized Proof of Claim Form has been mailed to all Class Members (according to Sotheby's and Christie's records and books) on August 12, 2003. The Proof of Claim Form sets forth transactions(s) upon which you are able to base a claim for recovery against the Settlement Fund. The Proof of Claim Form also provides an estimate of your distribution amount. The Hammer Price(s) listed in Section II of the Claim Form is in the currency in which the item was originally purchased or sold. Your Estimated Distribution Amount, shown at the bottom of your preprinted transaction form, has been correctly calculated in accordance with the terms of the Settlement and is correctly shown in U.S. dollars.
The deadline for requesting and submitting a Proof of Claim Form has passed. The filing deadline was June 6, 2006.
PLEASE NOTE: In the case of Buyer Eligible Class Members, filing the Proof of Claim for the first distribution was your only opportunity to participate in the distribution of monies from the Settlement Fund. There will be only one distribution to Buyer Eligible Class Members. For Seller Eligible Class Members, the submission of the Proof of Claim Form will permit your participation in the Second Distribution of Settlement proceeds allocable to Seller Eligible Class Members. The Order Granting Unopposed Motion For Authority to make Additional Distributions from the Settlement Fund for International Auction Houses Litigation was signed on January 22, 2007. The Second Distribution of bank drafts to Seller Eligible Class Members in the currency of the claimant's country will begin on March 21, 2007. Please allow some time for delivery.
Pursuant to the terms of the Settlement, there was to be only one distribution to the Buyer Eligible Class Members and two distributions to the Seller Eligible Class Members. The First Distribution of the International Auction Houses Litigation took place on November 4, 2005 and included claimants with valid sales or purchases (or both) during the stated Class Period who did not exclude themselves from the Class and who filed a claim prior to the January 15, 2004 due date. Only claimants with valid sales (consignments) transactions or Seller Eligible Class Members are eligible to participate in the Second Distribution.
